SHIPPING COSTS & PRICES

SECTION 5 SHIPPING CONDITIONS

  1. Delivery will be made to the delivery address provided by you. Delivery will only be made within Germany or to Austria.

  2. The delivery time within Germany is approx. 1 to 3 working days. The delivery time to Austria is approx. 2 to 4 working days. The delivery times are also stated in the shipping confirmation. Please note that no deliveries are made on Sundays or public holidays.

  3. We are entitled to provide partial services to the extent that you can reasonably be expected to accept such provision; any additional costs incurred as a result shall be borne by us. If you do not wish to receive a partial delivery, you must let us know by e-mail immediately after being informed of the delay in delivery.

SECTION 6 PRICES, SHIPPING COSTS

  1. The prices quoted in the respective offers as well as the shipping costs are the final prices. They include all price components including any applicable taxes.

  2. Unless delivery is provided free of charge, you will also pay shipping costs. The shipping costs are a) for shipping within Germany a flat rate of EUR 5.90 per order, b) for shipping to Austria a flat rate of EUR 15.90 per order. For orders with a value of EUR 60.00 upwards (excluding deposits) we deliver free of charge to Germany. For orders with a value of EUR 120.00 upwards we deliver free of charge to Austria. The shipping costs for other countries are listed below.

SECTION 7 PAYMENT TERMS

  1. Unless otherwise stated in the payment methods shown, the payment claims arising from the contracted contract are due for immediate payment.

  2. For deliveries within Germany, you have the following payment options:

  • Payment by credit card

  • Payment by Paypal

  • Payment by Sofortüberweisung

  • Payment on account (via KLARNA)

  1. Your credit card account will be charged upon completion of the order.

5. In cooperation with Klarna, we can offer you the option of paying on account. The payment period is 14 days from the invoice date. The invoice will be issued when the goods are dispatched and sent either by e-mail or together with the goods. Payment is made to Klarna. Please note that the Klarna invoice option is only available to consumers. The full terms and conditions for purchases made on account can be found here. The online shop charges a fee of EUR 0,- per order when purchasing on account with Klarna.

Klarna checks and evaluates your data and, where there is a legitimate interest and reason to do so, exchanges data with other companies and credit reference agencies. Your personal data will be handled in accordance with the applicable data protection rules and as detailed in Klarna's data protection policy.

SECTION 8 RIGHT OF RETENTION, RESERVATION OF TITLE, RESERVATION OF DELIVERY

  1. You may only exercise a right of retention insofar as it relates to claims from the same contractual relationship.

  2. The goods remain the property of the Provider until the purchase price has been paid in full.

  3. If, contrary to expectations, a product ordered by you is not available despite the timely conclusion of a corresponding coverage transaction for reasons for which the Provider is not responsible, you will be informed immediately about the unavailability. In the event of the contract being cancelled, any payments already made will be refunded immediately.

SECTION 9 WARRANTY

  1. The statutory provisions apply accordingly.

  2. As a consumer, you are requested to check the goods immediately upon delivery for completeness, any obvious defects and transport damage, and to notify the Provider and the carrier of any complaints as soon as possible. Failure to do so will not affect your statutory warranty rights.

SECTION 10 LIABILITY

  1. For claims under the Product Liability Act or damages due to fatalities, physical injuries or damage to health, the Provider shall be liable without limitation according to the statutory provisions.

  2. For other damages, the pre-contractual, contractual and non-contractual liability of the Provider is excluded in the case of minor negligence, unless there has been a breach of material contractual obligations (cardinal obligations). Cardinal obligations are those obligations that make the proper performance of the contract possible in the first place and on whose compliance you may regularly rely. In the event of a breach of a cardinal obligation, the liability of the Provider is, however, limited to the amount of the damages foreseeable and typical for the contract at the time of the contract being concluded. The above limitation of liability shall not apply in the event of a defect following the assumption of a guarantee for the quality of the product or in the event of fraudulently concealed defects.

  3. The limitation of liability according to para. 2 shall also apply in the event of fault on the part of vicarious agents and persons employed in performing an obligation, as well as members of the Provider's executive bodies.

  4. Data communication via the internet cannot be guaranteed to be error-free and/or available at all times according to the current state of the art. In this respect, the Provider is liable neither for the constant nor for the uninterrupted availability of the website and the service offered on it.

SECTION 11 FINAL PROVISIONS

  1. The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law shall only apply insofar as you are not deprived of the protection granted to you by mandatory provisions of the state in which you have your habitual residence (favourability principle).

  2. The place of performance for all services arising from the business relationship with the Provider is the Provider's registered office.

  3. The place of jurisdiction is the registered office of the Provider, insofar as you are not a consumer but a merchant, a legal entity under public law or a special fund under public law. This shall similarly apply if you do not have a general place of jurisdiction in Germany or the EU or if your place of residence or habitual abode is unknown at the time of the action being brought. This does not affect the right to bring an action before the court at another statutory place of jurisdiction.

  4. The Provider is entitled to change these GTC at any time with effect for future orders.

  5. Should any provision of these GTC be or become invalid or unenforceable, this shall not affect the validity of the remainder of the contract between the Provider and you.
